Camp Lejeune Victims Will Finally Be Entitled to File Compensation Claims After President Biden Signs the PACT Act

Veterans and family members who lived or worked at Camp Lejeune will have an avenue to pursue compensation.

Sommers Schwartz sees the passage of The Honoring Our PACT Act as a victory for veterans and their family members that may have been exposed to various toxins at Camp Lejeune. After in-depth discussion and multiple votes in both houses of Congress, the bill now heads to President Biden’s desk for signature. Once signed into law, the lawyers at Sommers Schwartz will be ready to fight for those who have experienced severe health issues.

The PACT Act offers medical support for veterans experiencing long-term health effects after exposure to toxic substances during their active service at various locations around the world. Part of the new law will provide an avenue of compensation for military veterans and family members who lived or worked at Camp Lejeune and have suffered a water toxicity-related illness.

To qualify, an individual must have lived and/or worked at Camp Lejeune for at least 30 days between Aug. 1, 1953, and Dec. 31, 1987, and thereafter suffered a qualifying illness, disease, or condition linked to the toxins in the contaminated water.

The Act also seeks to help veterans suffering from cancer and other conditions after being exposed to burn pits in Afghanistan and Iraq.

Once President Biden signs the Honoring Our PACT Act of 2022, it will initially allow Camp Lejeune victims to file a claim with the Department of the Navy. If an individual receives no response or a denial of the claim, the individual will be able to file a claim in the U.S. District Court for the Eastern District of North Carolina.

Punitive damages may not be awarded under this Act. Recoverable compensatory damages will include medical bills, lost wages, household expenses, travel expenses, cost of prescriptions, cost of home care, and costs of future surgeries and treatments.
